United States Second Circuit

US v. DeFonte, 06-1046

An order denying inmate-intervenor's motion for a protective order and requiring her to deliver certain documents to defendant, a correctional officer, in the course of his criminal prosecution is vacated where the district court erred in aspects of its findings that the documents were not protected by the attorney-client privilege and that the inmate had no expectation of privacy in the contents of her cell.
