Holowecki v. Fed. Express, 04-3376

Dismissal of age discrimination claims brought under state and federal law, for failure to file timely charges with the Equal Employment Opportunity Commission (EEOC), is reversed in part and vacated in part where: 1) documents filed by one plaintiff constituted an EEOC "charge" so as to fulfill the Age Discrimination in Employment Act's exhaustion requirements; 2) other plaintiffs could take advantage of that filing under the "piggybacking" rule; and 3) the district court erred in finding other plaintiffs did not timely file their charges.
