US v. Giordano, 03-1394

18 U.S.C. section 2425, involving the use a facility of interstate commerce for the purpose of enticing a person under the age of sixteen years to engage in sexual activity, reaches intrastate use of a telephone for the unlawful purposes specified in the statute, and application of the statute to such activity does not exceed Congress's power under the Commerce Clause.
