Xue v. Board of Immigration Appeals, 04-0374

Denial of petitioner's asylum claim is vacated and remanded where the immigration judge denied the petitioner an opportunity to address his apparent misgivings by basing his credibility ruling on perceived inconsistencies that were not self-evident and were not raised during petitioner's hearing.
