ROSE v. AMSOUTH BANK OF FLORIDA, 04-0389

The district court's judgment, finding plaintiff's assignment of a life insurance policy subordinate to defendant's assignment of the same policy, is reversed where defendant raised no defense that would justify subordinating plaintiff's otherwise valid assignment.
