The court vacated trial court's dismissal, because if the plaintiff could prove it's allegations that defendant actively assisted in the presentation of fraudulent evidence to an arbitration panel, reducing plaintiff's damage recovery in an previous related proceeding, collateral estoppel would be inapplicable.
