United States Second Circuit

WESTINGHOUSE CREDIT CORP v. D'URSO, 03-7368

In a bankruptcy appeal concerning the calculation of interest, lower court improperly applied the lower post-judgment interest rate to the judgment amount. The prejudgment rate should have been applied, because the earlier case which the court looked to in imposing the post judgment rate was vacated.
