DEVLIN v. US, 02-6128

District court erred in finding that plaintiff's claim is not one for "injury or loss of property" under the Federal Torts Claims Act. This is true regardless of whether one uses the state-incorporation approach or the uniform federal approach in defining "injury or loss of property" for the purposes of 28 U.S.C. section 1346(b)(1).
