KHAN v. ASHCROFT, 03-2126
Dismissal of habeas corpus petition challenging the constitutionality of Section 440(d) of AEDPA, which eliminated the Attorney General's discretionary authority to grant waiver of deportation to an alien convicted of an aggravated felony, as applied to an alien whose offense conduct predated AEDPA's effective date, is affirmed.
