US v. AWADALLAH, 02-1269

In an action arising from an investigation of the 9/11 terrorist attacks, dismissal of an indictment charging defendant with making false statements to a grand jury is reversed where, 1) 18 U.S.C. section 3144, allows the arrest and detention of grand jury witnesses, 2) the material witness warrant was valid, and 3) the court erred in suppressing evidence as the fruit of Fourth Amendment violations.
