United States Second Circuit

ASTRA OIL CO., INC. v. ROVER NAVIGATION, LTD., 02-9388

Although plaintiff was not a signatory to the contract containing the arbitration clause it now seeks to enforce, the petition to arbitrate should have been granted because plaintiff's claims arise under duties allegedly created by the contract, which defendant had signed, and the relationships among the parties are sufficiently close that defendant is estopped from avoiding the obligation to arbitrate.
