AM. BOOKSELLERS FOUND. v. DEAN, 02-7785

Plaintiffs have standing to challenge 13 V.S.A. section 2802a, which prohibits distributing sexually explicit materials to minors, and as applied to plaintiffs' internet speech, section 2802a violates the First Amendment because it burdens protected communications and is not narrowly tailored, and violates the dormant Commerce Clause because it projects Vermont's regulatory regime onto the rest of the nation.
