DIBBLE v. FENIMORE, 00-6243

An interlocutory order denying the motion of the Commander of the State National Guard to dismiss the suit by reason of the doctrine of intra-military immunity is immediately appealable under the collateral order rule of Cohen v. Beneficial Industrial Loan Corp., 337 U.S. 541 (1949). Such a suit is non-justiciable under the doctrine of intramilitary immunity.
