New York's Air Pollution Mitigation Law, N.Y. Pub. Serv. L. section 66-k, is preempted by Title IV of the Clean Air Act Amendments of 1990, 42 U.S.C. sections 7651-7651o, and therefore violates the Supremacy Clause of the US Constitution.
