In breach of contract action based on defendant's failure to indemnify plaintiff for amounts paid to settle claims by the bankrupt estate of a law firm, the district court's action of setting aside the initial jury verdict in plaintiff's favor and denying a new trial based on a tainted jury, were within its discretion.
