OSCAR GRUSS & SON, INC. v. HOLLANDER, 02-7087, 02-7133

In a breach of contract action, although subject matter jurisdiction exists, the district court's determinations of 1) damages for failure to deliver warrants, and 2) third party indemnification clause permitted an award of attorney fees, are vacated because damages should have been calculated from the date of the breach.
