NEWMAN v. WARNACO GROUP, INC., 02-9157

Where, as a matter of law, plaintiff stockholders were not placed on inquiry notice of any alleged fraud by a Form 10-K filed by defendant corporation, the district court's dismissal as time-barred of the action for fraudulent securities violations is reversed.
