GERBER v. KAYNE, 02-7023

In an appeal of settlement approval, the district court correctly deferred allocation of a judgment credit until after trial. The Private Securities Litigation Reform Act of 1995 does not apply to the claims of the nineteen plaintiffs who were added by amendment to the complaint after the statute's effective date.
