US v. LASAGA, 02-1144
Convictions for receipt of child pornography in violation of 18 U.S.C. section 2252A(a)(2) and possession of child pornography in violation of 18 U.S.C. section 2252A(a)(5)(B) are affirmed, but sentence is vacated on the grounds that the district court erred by granting an upward departure under U.S.S.G. section 5K2.3.
