CEPHAS v. NASH, 02-2152

Defendant cannot invoke section 2241 jurisdiction to claim actual innocence with respect to his 18 U.S.C. section 924(c) conviction for carrying a firearm because he already unsuccessfully raised such a claim in a section 2255 motion and Muscarello v. US, 524 U. S. 125 (1998) provides no new support for his argument.
