CHRZANOSKI v. ASHCROFT, 02-2531
Use of force is not an element of Connecticut General Statutes section 53a-61(a)(1), thus third degree intentional assault under Connecticut law is not a crime of violence under 18 U.S.C. section 16(a). The INS committed legal error when it removed plaintiff based on its determination that third degree intentional assault was a crime of violence under - 16(a).
