DESIANO v. WARNER-LAMBERT CO., 01-9318

Because plaintiffs' suit, for relief on behalf of all health benefit providers that paid for Rezulin, involves claims of damages that were caused directly by defendants' alleged fraud, dismissal for failure to state a claim under Fed. R. Civ. P. 12(b)(6) is reversed.
