CANTOR FITZGERALD INC. v. LUTNICK, 01-7291

The district court erred in applying federal law in a breach of fiduciary action in diversity, to determine when the statute of limitations period began to run, but plaintiffs were on inquiry notice more than three years prior to suit, thus the action is barred under either California or Nevada law.
