A shipper demonstrated a fortuitous loss under an all-risk insurance policy where it lost possession of cargo upon seizure by Russian authorities, and unsuccessfully exerted diligent effort to regain the cargo. Material fact issues exist as to whether the War Exclusion Clause excludes insured's loss from coverage.
