United States Second Circuit
US v. CRISPO, 00-1711/12
A trustee in bankruptcy is an "officer" within the contemplation of the obstruction of justice statute, 18 U.S.C. section 1503(a). To justify upward departures for both a vulnerable victim and a psychological injury, the court must find a psychological injury much more serious than one would expect from a crime involving a vulnerable victim.
