SMITH v. LOCAL 819 I.B.T. PENSION PLAN, 01-7583

Administrators of a pension plan sufficiently stated ERISA and state claims for indemnity and contribution where a plan participant sought relief retroactive to the time when insurer administered the plan, and deficiencies in the plan attributable to the insurer may have proximately caused (under a negligence theory) or "enabled" (under ERISA) any deficiencies in the plan's reformation.
