SPENCER v. BOGDANOVICH, 01-5007

In light of uncertainty as to whether some misrepresentations made by bankruptcy debtors satisfy the nondischargeability exception for fraudulent statements under 11 U.S.C. section 523(a)(2)(A), bankruptcy court abused its discretion in lifting a stay preventing plaintiffs from reducing their favorable verdict into a final judgment.
