US v. RYBICKI, 00-1043, 00-1044, 00-1052, 00-1055

In order to convict defendants of mail and wire fraud based upon a "scheme to defraud", as in 18 U.S.C. section 1346, all that is required is proof 1) that the defendants engaged in a scheme to defraud; 2) with the intent to deprive; 3) it was foreseeable that the scheme could result in economic or pecuniary harm (more than de minimis); and 4) that the mails were used in furtherance of the scheme.
