HALLWOOD REALTY PARTNERS, L.P. v. GOTHAM PARTNERS, L.P., 01-7246

In this case of first impression, district court correctly held that section 13(d) of the Securities and Exchange Act does not provide a damages remedy to issuers; circumstantial evidence was properly considered in determining whether a group existed under section 13(d), and rulings striking plaintiff-s jury demand and dismissing remaining claims for injunctive and declaratory relief were affirmed.
