United States Second Circuit

NORDE v. KEANE, 01-2049

The state court's denial of defense counsel's request during voir dire for an adjournment to consult with her client upon defendant's removal from the courtroom, and court's communication with defendant through a court officer rather than counsel, unconstitutionally deprived defendant of the assistance of counsel at a critical stage of the proceedings.
