United States Second Circuit
DENSBERGER v. UNITED TECH. CORP., 00-9512
Because the Connecticut Products Liability Act does not expressly prohibit post-sale liability for negligent failure to warn, the negligence-based common law duty survives and is cognizable under the statute; the government contractor defense does not apply to limit the warnings that a reasonable seller would provide to the government itself.
