United States Second Circuit
SANCHEZ v. DUNCAN, 00-2629
Where (1) the defendant was present in the courtroom for the entire jury selection process; (2) defense counsel participated in all bench conferences, and defendant had ample opportunity to consult with his attorney; and (3) of the prospective jurors who attended the bench conferences, none actually served on the jury, defendant's absence from voir dire bench conferences was harmless.
