EISENBERG v. ADVANCE RELOCATION, 00-7216
Under Title VII of the Civil Rights Act of 1964, 42 USC 2000e-2, et seq., an "employee" is determined by the extent to which the hiring party controls the manner and means by which the worker completes her assigned tasks, rather than on how she is treated for tax purposes or whether she receives benefits.
