IAVORSKI v. INS, 00-4086

The filing deadline for motions to reopen deportation proceedings may be equitably tolled when ineffective assistance of counsel caused the alien to miss the deadline, but the alien must exercise due diligence once he discovers the ineffective assistance of counsel.
