United States First Circuit

US v. Powell , 17-1683

Affirmed the denial of a request to withdraw a guilty plea to production of child pornography. On appeal, the defendant argued that he should be allowed to withdraw his guilty plea because his counsel had provided him ineffective assistance by failing to file a motion to suppress certain evidence. However, in affirming the denial of his request, the First Circuit found that he failed to show that the suppression motion would have been meritorious, so there was no error.
