Hajdusek v. US , 17-2137
Affirmed the dismissal of a Federal Tort Claims Act claim filed by a marine recruit who alleged that he suffered serious physical injuries while participating in the Marine Corps Delayed Entry Program. In affirming the dismissal, the First Circuit held that the recruit was barred from pursuing his claim for damages because it stemmed from a government official's performance of a discretionary function and the government had not waived its sovereign immunity.
