US v. Rivera-Hernandez, 16-2144

Affirming district court's decision to depart from a plea agreement in imposing an upward departure from the guideline range, rather than the bottom-of-the-range sentence, in the case of a man who pled guilty to transporting child pornography because the court was not bound to the plea agreement's terms and attacks on the guidelines themselves were of no avail.
