United States First Circuit
Wilber v. Curtis, 16-2250
Affirming in part the grant of summary judgment dismissing a lawsuit filed by a Massachusetts property owner against three police officers for an arrest in connection with their objection to the clearing of vegetation from his property by a work crew for a public utility that held an easement on the property because the officers met the burden of establishing probable cause on qualified immunity grounds, but vacating and remanding to state court the grant of summary judgment for false imprisonment because the merits of false arrest and imprisonment claims depend on jury rulings on probable cause.
