In a case where a convict challenging their sentence enhancement died before an opinion was issued granting the appeal of the grant of their habeas corpus petition was affirmed by the court the counsel for the deceased opposed the government's motion for the withdrawal of the opinion and the court exercised its discretion to grant the government motion for the opinion's withdrawal because the case had become moot.
