United States First Circuit

US v. Nunez, 15-2412

Sentence enhancement based on circumstantial evidence which attributed constructive possession of six Molotov cocktails to defendant, is affirmed where, although the government offered no direct evidence that he possessed the Molotov cocktails, given the quality and quantity of the circumstantial evidence here, the sentencing court's constructive possession finding was not clearly erroneous.
