United States First Circuit
US v. Celaya Valenzuela, 16-1009
In a criminal prosecution arising out of a sting operation, codenamed Operation Dark Water, targeting the Sinaloa Drug Cartel, defendant's conviction and sentence of conspiracy to distribute and possess with intent to distribute controlled substances, 21 U.S.C. section 846, are affirmed over defendant's meritless claims that: 1) the government failed to prove that the conspiracy in question had a 'jurisdictional nexus' to the U.S.; 2) the government 'manufactured' venue in the District of New Hampshire by driving a co-conspirator from Boston's Logan Airport across the border into New Hampshire for a meeting; and 3) his prison sentence was substantively unreasonable.
