US v. Nieves-Mercado, 15-1627
Above-guidelines sentence for guilty plea to carjacking and aiding and abetting in violation of 18 U.S.C. section 2119(1) is affirmed over defendant's claims that the sentence was procedurally and substantively unreasonable, where the district court did not abuse its discretion by considering purportedly unreliable evidence, by varying upward based on information already factored into the guidelines sentencing range, nor by ignoring 'the significant mitigating factor' of his youth.
