United States First Circuit

US v. Swan, 14-1672

Convictions for Hobbs Act extortion, 18 U.S.C. section 1951(a), tax fraud, 26 U.S.C. section 7206(1), and making false statements to obtain federal worker's compensation, 18 U.S.C. section 192, are affirmed over defendant's claim that the district court erred in denied defendant's motion to suppress incriminating statements made during her interview with two sheriff's deputies, where: 1) a reasonable person in defendant's position would have felt able to terminate the interview and leave the station; and thus 2) defendant was not subjected to a custodial interrogation, and it was unnecessary to provide her with Miranda warnings.
