United States First Circuit

In re: Nexium Antitrust, 15-2005

In an appeal arising from the first pharmaceutical-settlement antitrust action tried before a jury since the Supreme Court's decision in FTC v. Actavis, Inc., 133 S. Ct. 2223 (2013), the jury verdict in favor of defendants is affirmed over plaintiffs' challenges where there is no reversible error in the district court's evidentiary rulings, the formulation of the special verdict form and jury instructions, or its judgment as a matter of law on overarching conspiracy.
