United States First Circuit

US v. Betancourt-Perez, 14-1175

In a civil forfeiture action concerns jewelry found by government agents during the execution of a search warrant, which claimant claims belonged to him lawfully and was unrelated to the illegal drug activities that are the subject of his criminal case, the district court grant of summary judgment to the government and order that the jewelry be forfeited are vacated where the district court incorrectly granted summary judgment because the government has not done enough to establish a link between the jewelry and defendant's drug activities by a preponderance of the evidence.
