In an action to avert the foreclosure of her home after seeking a mortgage modification under the Home Affordable Modification Program (HAMP), the District Court's grant of summary judgment to defendant banks on her claims of breach of contract and unfair debt collection under Massachusetts General Laws ch. 93A, is affirmed where: 1) plaintiff's failure to prove damages is fatal to her breach of contract claims; and 2) plaintiff cannot demonstrate a causal relationship between her loss and the alleged deceptive practices under ch. 93A.
