Sentence and conviction by guilty plea to being a felon in possession of a firearm and ammunition, is: 1) affirmed as to conviction over defendant's claim of Fourth Amendment violation; and 2) vacated as to sentence where the District Court mistakenly concluded that a United States Sentencing Guidelines enhancement for career offenders applied to him.
