Lopez v. City of Lawrence, Massachusetts, 14-1952
In a suit involving a test used to determine promotions for police officers, claiming that the use of a particular test resulted in an unjustified "disparate impact" in violation of Title VII notwithstanding the absence of any intent to discriminate on the basis of race, 42 U.S.C. section 2000e-2(k)(1)(A)(i), the District Court's judgment is affirmed where it applied the correct law and committed no clear error in finding persuasive the expert evidence tendered by defendant.
