US v. Montero-Montero, 15-1405

Upward departure from guideline sentence imposed in connection with a violation of the conditions of defendant's supervised release for an earlier conviction for conspiracy to possess with intent to distribute narcotics, 21 U.S.C. sections 841(a)(1) and 846, is vacated and remanded for resentencing where the district court's utter failure to explain its sharp upward variance requires vacation of the sentence.
