Miranda-Rivera v. Toledo-Davila, 14-1535

In a suit under 42 U.S.C. section 1983 brought by family members of a decedent who died in a police holding cell after being arrested for driving under the influence, alleging that the arresting officers used excessive force against decedent and denied him needed medical care, the district court's grant of summary judgment to defendants on insufficient evidence and qualified immunity grounds, is: 1) affirmed in part as to claims against Superintendent Toledo; and 2) reversed and remanded in part as to claims against Officer Perez and Sergeant Rodriguez.
